米国出版社協会（AAP）は2008年3月、国立衛生研究所（NIH）のパブリックアクセス方針について、著作権法に規定されている著作物の保護を脅かすものとして、NIHに対し再考を求める書簡を送っています。これに対し、2008年7月、北米研究図書館協会（ARL）とSPARCが、「NIHのパブリックアクセス方針は著作権法に反しない」と、AAPの主張に反論するレポートを作成、公開しています。
