欧州委員会（EC）は、2011年9月20日付けで、欧州の図書館団体・出版社団体・著作者団体の10団体・機関が、著作権保護期間内の絶版資料のデジタル化と利用の原則について合意したと発表しています。合意された覚書（Memorandum of Understanding：MoU）は、図書館等が所蔵する図書や学術雑誌で絶版となっているものをデジタル化しオンラインで公開する際の原則を定めたもので、実施にあたっては著作権を尊重しつつ関係者間での自発的なランセンス合意に基づくこと等の内容が含まれているようです。EUの指令等ではなくMoUという形となったのは、関係者間での交渉による柔軟な対応をするためとのことで、また、2011年5月にECが示した孤児作品に関する指令の案とは補足的な関係にあるとのことです。なお、MoUでは、電子出版の可能性をふまえ、「絶版」（out of print）という用語ではなく、「商業的利用がされていない」（out of commerce）という用語が使用されています。合意したのは下記の団体・機関で、ECは調整役を担っていました。
