EU欧州委員会の下で欧州デジタル図書館の著作権問題を協議してきたHigh Level Expert Group on Digital Librariesは、Orphan Worksと絶版本の著作権の取り扱いについての解決モデルを提示しました。
今回提示されたモデルでは、Orphan Worksは著作権者の調査を行った後非営利的な目的であればデジタル的複製を認めることを勧告、絶版本については国立図書館内などクローズドな環境の中で所蔵品のデジタル化と閲覧を非排他的に認めるライセンスを与えるよう提案しています。
なお、High Level Expert Group on Digital Librariesには、英国図書館（BL）など図書館界とFederation of European Publishers、Association of Scientific, Technical and Medical Publishers (STM)など出版界の代表、Council of the European University Associationといった大学・学術界の代表、Google社の代表等が含まれています。
